<p><img style="float: left; margin-top: 5px; margin-bottom: 5px; margin-left: 10px; margin-right: 10px;" title="McDonalds" src="http://tbn2.google.com/images?q=tbn:FxyW_hbBZuDwwM:http://osmoothie.com/wp-content/uploads/2008/01/mcdonalds.jpg" alt="McDonalds" width="143" height="107" />An act described as heroism by some is under the gun by a major US Corporation, <strong>McDonalds</strong>.  Last August, a <strong>McDonald&#8217;s employee</strong> &#8212; <em>Nigel Haskett</em> was shot while trying to stop a man from hitting a women inside the <strong>McDonald&#8217;s</strong> where he worked. However, <strong>McDonald&#8217;s</strong> has now issued a denial of workman&#8217;s comp to <em>Mr. Haskett</em>.</p>
<p>The shooter is behind bars. <em>Nigel Haskett</em> is now taking <strong>McDonald&#8217;s</strong> to court. Here&#8217;s what went down: It appears a woman and a man were sitting in <strong>McDonald&#8217;s</strong> (possible customers) when the man got up and hit the woman in the face. After the first hit, the <strong>McDonald&#8217;s</strong> employee &#8212; <em>Haskett</em> jumped to her aid and got the man outside where he was shot.</p>
<p><em>Haskett</em> spent over a month in the hospital. The judge handling the criminal case called <em>Haskett</em> a hero. However, the risk management agent that represents <strong>McDonald&#8217;s</strong> says that the <strong>McDonald&#8217;s</strong> employee heroism won&#8217;t be rewarded with worker&#8217;s comp.</p>
<p><em>&#8220;&#8230; we have denied this in it&#8217;s entirety as it is our opinion that Mr. Haskett&#8217;s injuries did not arise out of or within the course and scope of his employment.&#8221;</em></p>
<p style="text-align: center;">You be the Judge &#8212; watch the video and make a comment</p>

<p><img style="float: left; margin-top: 5px; margin-bottom: 5px; margin-left: 10px; margin-right: 10px;" title="Civil Litigation" src="http://tbn1.google.com/images?q=tbn:3eepoabo_XUu2M:http://www.johnsonlaw.us/grafix/civil.jpg" alt="Civil Litigation" width="121" height="82" />Not all <em>civil disputes</em> are resolved in court.  Most disputes are resolved before you reach the court house.  How are disputes resolved without going to court?</p>
<p> </p>
<p>Here are several methods to resolve a dispute before going to court.</p>
<p> </p>
<ol>
<li>Settlement</li>
<li>Mediation</li>
<li>Arbitration</li>
</ol>
<p> </p>
<p><strong>Settlement Between Disputing Parties<img style="float: right; margin-left: 10px; margin-right: 10px;" title="Settlement" src="http://tbn0.google.com/images?q=tbn:HJowxq3Dgg0CkM:http://www.localwin.com/julie/system/files/lu10/Settlement.jpg" alt="Settlement" width="130" height="87" /></strong></p>
<p>Probably the most common method of resolving disputes is <strong>settlement</strong>. In a <strong>settlement</strong> the disputing parties discuss their problems with one another and reach an agreement. attorneys and the legal system may never enter the picture.</p>
<p> </p>
<p><strong>Mediation Between Disputing Parties<img style="margin-left: 10px; margin-right: 10px; float: right;" title="mediation" src="http://tbn3.google.com/images?q=tbn:hlun50SQsT3VEM:http://sykesacademy.com/MediationMtg.jpg" alt="mediation" width="135" height="108" /></strong></p>
<p>Another method of resolving disputes is the process of <strong>mediation</strong>. <strong>Mediation</strong> is a form of settlement that uses a third person, known as a mediator. The mediator helps the parties come to an agreement to settle their differences. Mediation has become a popular practice.</p>
<p> </p>
<p><strong>Arbitration Between Disputing Parties<img style="float: right; margin-left: 10px; margin-right: 10px;" title="Arbitration" src="http://tbn3.google.com/images?q=tbn:8YWrNyVL8mSMnM:http://msct.beyondintractability.org/images/aha/arbitration.jpg" alt="Arbitration" width="108" height="94" /></strong></p>
<p>Another alternative to civil litigation is <strong>arbitration</strong>. The process of <strong>arbitration</strong> is similar to that of court litigation. The main difference is that none of the proceedings take place in court. as a result <strong>arbitration</strong> is usually more efficient and less expensive than court proceedings.</p>
