Not all civil disputes are resolved in court. Most disputes are resolved before you reach the court house. How are disputes resolved without going to court?
Here are several methods to resolve a dispute before going to court.
- Settlement
- Mediation
- Arbitration
Settlement Between Disputing Parties
Probably the most common method of resolving disputes is settlement. In a settlement the disputing parties discuss their problems with one another and reach an agreement. attorneys and the legal system may never enter the picture.
Mediation Between Disputing Parties
Another method of resolving disputes is the process of mediation. Mediation is a form of settlement that uses a third person, known as a mediator. The mediator helps the parties come to an agreement to settle their differences. Mediation has become a popular practice.
Arbitration Between Disputing Parties
Another alternative to civil litigation is arbitration. The process of arbitration is similar to that of court litigation. The main difference is that none of the proceedings take place in court. as a result arbitration is usually more efficient and less expensive than court proceedings.
